RE: Water Service to Your Prospective Sub-Division Property
Dear Prospective Property Seller:
Tryon Road Special Utility District welcomes you as a prospective seller of property within the TRSUD service area. Before you proceed to offer portions of your property for sale, TRSUD hopes that you will contact the TRSUD office to confirm the availability of water and/or wastewater service to your property and the rules of the TRSUD for providing water service to prospective buyers of your property. We believe that the availability of water and/or wastewater service to your property will greatly enhance the value of your property in the eyes of your prospective buyers.
You should be aware that TRSUD attempts to inform developers and other sellers of property of their obligations in providing facilities that make water and/or wastewater service easily and readily available on property offered for sale. In those cases where the rules of TRSUD are ignored, service is refused until inadequate facilities are improved or facilities are extended into areas that are without infrastructure. If property is offered for sale under the premise that water and/or wastewater service is available where, in fact, it is not available, TRSUD will not expend district funds to extend service. The seller may be liable for damages which will be payable to the buyer of the property and TRSUD will not be a party to this.
In addition, the prospective seller of property is advised that development within the system is not static. As a result, conditions in existence at one time of inquiry may not be in existence at a significantly later date. Therefore, it is imperative for you as a prospective seller of property to identify and lock-in as soon as practicable any costs associated with extending or improving facilities necessary to provide water and/or wastewater service to your property. Working closely with TRSUD staff will ensure you that your costs are identified.
Please be assured that TRSUD desires to work with you as a seller of property and is dedicated to providing your development with a plentiful, high quality water service for the use of your property buyers.
